General Contracting Conditions

The website offers the service of contracting sessions online, which means a 24-hour service that is simple, direct, and available from anywhere through an Internet connection.

1. General Information

All prices are in Euros and are in accordance with current legislation.

The Owner reserves the right to refuse the contracting of any user with whom she has a dispute or with whom there have been problems in regards to the payment of previous contracts.

2. Obligations of Users

All users who agree to a contract through this website declare that they are of legal age and, where appropriate, possess the full capacity to not only use payment methods, but that they have sufficient funds to cover all costs that result from the contracting of services. The User also declares to fully and unreservedly accept all the conditions of the Legal Notice.

The User may establish one or more requests for the contracting of services offered through the website.

3. Payment Methods and Security

In compliance with Commission Delegated Regulation (EU) 2018/389 of 27 November 2017 supplementing Directive (EU) 2015/2366 of the European Parliament and of the Council of 25 November 2015 on payment services in the internal market, the User making an online payment transaction must do so by means of strong authentication. Depending on the chosen means of payment and the economic value of said payment, with the exceptions provided for in the Directive, the User will have to provide a second identification factor before placing an order, such as a PIN code that the User will receive on their mobile phone and that they will have to enter to validate their purchase.

According to the PSD2 Directive, strong authentication exists when at least two of the following elements are used for authentication:

Knowledge (something that only the User knows, e.g. a password, PIN code, access data, etc.)

Possession (something that only the User has, e.g. a mobile phone where an SMS is sent to verify the operation, an email address, etc.)

Inheritance (something that the User is, e.g. the possibility of biometric verification, whether by fingerprint, facial recognition, etc.)

These elements are independent of each other. In other words, a breach of one does not compromise the reliability of the others, and the confidentiality of identification data is always protected.

For the convenience of the User, we provide different ways to make the payment:

1) Credit card

– This payment method is immediate, totally secure, and verified by secure servers in the payment gateway. Under no circumstances will credit card details be disclosed.

– Only secured credit cards will be accepted to avoid any possible risk or fraud. Secured cards have security codes associated with them and, when the payment is completed, they are transferred to the bank’s payment gateway, where these codes must be entered. If the User does not have a secured card for online payments, the bank must provide the necessary information and passwords.

2) PayPal

– This payment method allows buyers and businesses to send and receive money online. By selecting this method at the time of finalising the order, the User will directly access the PayPal website. The User does not need to enter bank details, they only need to have a PayPal account created and can then make payments by entering only their email and password. The User can also create the account at the time of payment or make the payment directly by entering the details of the credit card. The data entered on the PayPal website is not communicated with the Owner.

3) Bizum

– This payment method is a service that allows the sending and receiving of money via mobile phone.

– In order to use Bizum as a means of payment, the User must request a password from their bank’s app. This is a unique 4-digit code, similar to a card PIN. Then, the phone number and the Bizum password must be entered. The bank will send a code that must be entered to validate the purchase. Finally, once the payment has been authorised, the amount will be debited from the associated bank account.

4. Right of withdrawal

In compliance with Law 3/2014, of 27 March, which amends the revised text of the General Law for the Defence of Consumers and Users and other complementary laws, approved by the Royal Legislative Decree 1/2007, of 16 November, information is provided on the User’s right of withdrawal.

4.1 Information to the consumer and user on the right of withdrawal.

a) The User has the right to withdraw from this contract within 14 calendar days without the need for justification.

b) The withdrawal period will expire 14 calendar days from the day of the conclusion of the contract.

c) To exercise the right of withdrawal, the User must notify us of their decision to withdraw from the contract by means of an unequivocal statement (e.g. a letter sent by post or email). You may use the model withdrawal form below, but its use is not mandatory.

d) In order to comply with the withdrawal period, it is sufficient that the communication concerning the exercise of this right by the User is sent before the expiry of the withdrawal period.

e) In the event of withdrawal by the User, the Owner shall refund all payments received without undue delay and, in any case, no later than 14 calendar days from the date on which we are informed of the decision to withdraw from the contract.

4.3 According to Law 3/2014, of 27 March, which amends the revised text of the General Law for the Defence of Consumers and Users and other complementary laws, approved by the Royal Legislative Decree 1/2007, of 16 November, in its art. 103, the right of withdrawal will not be applicable to contracts that refer to (among others):

a) The provision of services, once the service has been fully executed, when the execution has begun, with the prior express consent of the consumer and user and with the acknowledgement on their part that they are aware that, once the contract has been fully executed by the entrepreneur, they will have lost their right of withdrawal.

In relation to this section, with the User’s order, the User gives their prior express consent, with the knowledge and acceptance on their part of the exceptions contained herein, and consequently in such cases, they lose their right of withdrawal.

5. User Support

The User will have a User Support service, for which the User can use the contact form, after which they will receive a reply as soon as possible (the User can also use the telephone number +34 624 35 95 53 during business hours).

6. Dispute resolution platform

Regulation (EU) No 524/2013 of the European Parliament and of the Council of 21 May 2013 sets out the objective of achieving a high level of consumer protection and the proper functioning of the internal market, in particular its digital dimension, by providing a European online dispute resolution platform to facilitate the out-of-court resolution of disputes between consumers and online traders in an independent, impartial, transparent, effective, and fair manner.
